These terms govern your use of Portrais. By creating an account, uploading photos, or buying a package, you agree to them. Please read them together with our Privacy Policy.
1. Who we are
Portrais is operated by lalec (lalec.ch), a sole proprietorship based in Switzerland (“we”, “us”). You can reach us at hello@portrais.com.
2. The service
Portrais generates studio-style headshots from reference photographs you provide. Outputs are AI-generated images: they aim to reproduce your likeness faithfully but are synthetic renderings, and exact results vary between generations.
3. Eligibility and your account
- You must be at least 16 years old to use Portrais.
- You are responsible for activity under your account and for keeping your sign-in secure.
- You agree to provide accurate information and to use the service lawfully.
4. Photos you upload
By uploading reference photos, you confirm that:
- they are of you, of someone who has given you explicit permission to use their image, or of your child if you are their parent or guardian;
- you hold all rights necessary to upload and process them; and
- they do not infringe anyone’s rights and are not unlawful.
You grant us a limited, revocable licence to process your uploaded photos solely to generate and deliver your order. We do not use them to train models or for any other purpose, and they are deleted automatically 7 days after upload (see the Privacy Policy).
5. Acceptable use
You agree not to use Portrais to:
- upload images of anyone without their consent, or impersonate or misrepresent another person;
- create deceptive, harmful, harassing, or fraudulent content;
- generate unlawful, infringing, or sexually explicit material; or
- resell, scrape, disrupt, or reverse engineer the service.
We may suspend or terminate accounts that breach these terms.
6. Your images and our platform
- You own the headshots we generate for you and may use them for personal and commercial purposes, subject to these terms.
- You retain all rights in the reference photos you upload.
- We retain all rights in the Portrais platform, software, models, prompts, branding, and website.
7. Packages, payment, and credits
- Headshots are sold as one-time packages of photo credits, priced in Swiss francs (CHF) and shown before purchase.
- Payments are processed by Stripe; by paying you also agree to Stripe’s terms. We never receive your full card details.
- Applicable taxes, if any, are shown or added at checkout.
8. Money-back guarantee and refunds
Headshots are digital goods generated on demand, and we want you charged only for what we deliver. Two protections apply:
- Failed generations. If a photo in your package fails to generate, its credit is refunded automatically.
- 14-day identity guarantee. If your delivered pack is not recognisably you, email hello@portrais.com with your run id within 14 days. We first regenerate the affected photos with a targeted correction; if that still does not satisfy, we refund the credit in full via Stripe (typically 3–5 business days, to your original card). You keep the photos either way.
The guarantee covers identity — such as a shifted hairline, wrong hair colour, or changed apparent age, build, or features. It does not cover taste — lighting, garment, or expression preferences, which you choose through the style options before generating. Full details are on our guarantee page.
9. AI output
Portrais produces synthetic images using third-party AI models. Beyond the guarantee in section 8, we do not warrant that outputs will be free of artifacts or fit for a particular purpose, and you are responsible for reviewing images before using them.
10. Warranties and liability
The service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages. Nothing in these terms excludes liability that cannot be excluded under applicable Swiss law.
11. Indemnity
You agree to indemnify us against claims arising from your breach of these terms or from photos you upload without the necessary rights or consent.
12. Termination
You may stop using Portrais and delete your data at any time. We may suspend or terminate access if you breach these terms or where required by law.
13. Changes
We may update these terms from time to time. The “Last updated” date reflects the current version, and continued use after a change means you accept it.
14. Governing law
These terms are governed by the laws of Switzerland, and the competent Swiss courts have jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
